Thank you for your email and for the update following the February 7 meeting.
First, regarding the prior timing, that delay was on our end. At the time, we were short-staffed and managing a heavy litigation caseload with court-imposed deadlines, and the review was not completed as quickly as it should have been. That said, the Department’s denial was also based on a separate issue, so the timing of the submission did not affect the outcome.
If the neighborhood would like to move forward again, we can prepare the updated reinstatement package promptly. We would expect to have the documents prepared and mailed to you next week (plus mailing time). Once the executed documents are returned to us, we will review and resubmit them to the Department within 14 days, likely sooner.
As for cost, we would not charge additional legal fees for completing the resubmission. The only expense would be mailing and related administrative costs. We will print the documents and send them to you for resident execution, and once you return the signed originals to us, we will handle the resubmission.
Please let me know if the association would like us to proceed, and we will get started right away.

Mr. Sunski,
I am following up regarding the HOA revival application and explain the response we received from the Department of Commerce. Unfortunately, Commerce rejected the submission on procedural grounds. I know this is frustrating, especially since this matter has been handled by more than one attorney and firm over time, so I want to clearly explain what Commerce identified and how we can move forward from here.
Department of Commerce’s response focused on the requirement that the revival be initiated by an organizing committee of at least three parcel owners, with a clear written statement identifying those individuals and their contact information. Although our intent to revive the association should have been evident from the submission itself, Commerce requires this to be more expressly stated and documented. I know that’s frustrating, but the revival process is heavily procedural and involves a fair amount of statutory red tape that leaves little room for flexibility.
The second issue is timing. Because Commerce viewed the prior owner consents as tied to that initial submission, they concluded the 60-day statutory window had closed. As a result, we need to treat this as a reset rather than a correction of the prior filing.
Moving forward, we can draft the required organizing committee statement to clearly establish initiation of the revival. We will also need new written consent forms will need to be signed by the owners. Our firm can prepare and print the consent forms and mail them to you for distribution and signature. After the consents are returned, we will promptly resubmit the revival package within the required timeframe.
I understand this is an aggravating outcome, especially given the effort already put in, but it is fixable. I’m happy to discuss this in more detail and answer any questions.

HOHA neighbors,
Just giving an update regarding the Deed Restrictions for the neighborhood. The lawyer has finely sent in all the paperwork to Tallahassee for review. Now I'm waiting on a call back from the lawyer to see if the neighborhood deed restrictions will be reinstated.
When I get that call, I will set up a HOHA meeting.
